Ethiopia activists found guilty

An Ethiopian court has convicted two anti-poverty activists of inciting violence after the elections in 2005.

Daniel Bekele, who works for ActionAid International, and local charity worker Netsanet Demissie could face up to 10 years in prison.

The men were acquitted of more serious charges of violating the constitution.

They were the last of more than 130 defendants charged in relation to the protests complaining of fraud in polls won by the prime minister's party.

ActionAid spokesman Tony Durham said the group were dismayed by the verdict.

The men will be sentenced on Wednesday.

Pardons

"Despite the lack of evidence proving their involvement in leadership and participation during the unrest, no evidence could be found to refute accusations of incitement," judge Mohammed Aminsani told the court, AFP news agency reports.

"As a result, the court has found them guilty on this respect."

Hundreds of thousands of people took part in demonstrations at alleged vote-rigging and some 193 people were killed.

Most of the dead were protesters, killed by security forces.

In August, the authorities pardoned more than 30 opposition members detained after the protest march two years ago.

Their release came a month after 38 senior opposition members were freed after signing a letter of pardon acknowledging a role in the disorder after the polls.

These two advocates have their own courage and conviction that probably carries them through the days and weeks, and their spirit and concious hopefully is more FREE than their caged existance.

For the concerned public, those who advocated on their behalf, prayed, the international organizations who stood by their side consistently through this ordeal, it is a blow on the face for Christmas eve.

One can probably find comfort in remembering, Prof. Alemayehu Gebremariam's tribute to "the prisoners of conscience" the day they were sentenced to life. In his words,"Thank you great patriots". Some times it is not the details of the case, but it is expectation and and how human beings stand against adverse and may be unjust results.

The bigger charges are dropped and it means seven more years in Kality. The case will be prolonged as hopefully they will APPEAL it.
Please DON'T GIVE UP and there is a feeling that you know exactly what you are doing. This may look like DEFEAT, but may be it realy is NOT.

If you read what the witnesses said in the court, they did what they are convicted about. Because they are high profile people who have support of high level people doesn't make them free. If they want to be pardon it is up to them to request, however they should be found guilty. ( I am not supporter EPDRF in anyway)

What the heck is that? Is that justice? I am not sure if I have heard of anything of this sort before. Let me put it this way - we are accusing you of killing somebody. As it turns out, we found no evidence to prove the case. We will, however, convict you and lock you up because there is no evidence to prove you didn't commit the crime. What kind of twisted logic is that? It is laughable.

You know what atheists say to prove their point that God doesn't exist? They say God doesn't exist because there is no way to prove that he does. And theists answer - God exists because there is no way of proving that he doesn't. Pick your battle!

I am sorry that the theory of pardon may not be the norm and applicable for all and they should not neccessarily be persuaded in a direction they chose not to take in their very vase.

One of them is a lawyer him self. The punishment was even more severe because "they are supposed to know better". All lawayers are born equal and in similar profession, but each is a unique person in the way he or she understand the universe and its application to humanity.

Is that all? How can a government be so stupid, blind and shameless to publish such a statement? One has to be so much arrogant and overconfident to utter such a judicial nonsense or one is simply an idiot.

I do not know what these two men really committed, if they committed any violent action at all. However, for a judge to give such an answer on why he convicted them shows how sick, manipulated, dependent and undemocratic our judicial system is. The rule of law in any democratic state accepts the fact that a court decision should be in favour of the suspect if there is no conclusive evidence to be brought up against him.

Whatever the issue, this arguement by the judge is a shame. It seems that the wretched judge received the decision from the government and he did not know what to tell the journalists.

Even if the government may pardon the two men at some later time, depending on whether such an action may be useful for the ruling party, the whole circus shows again the tragedy in Ethiopia.

The government seems to overlook the fact that, by handing out such court rulings, it is creating martyrs and opposition figures out of people that might not have had such an intention. This court ruling may again be a sign of how desperate a government should be to resort to such measures in oder to get rid off potential "trouble makers".

Those of us with the privilege of writing our "wisdom" in this forum should keep in mind that whatever political line we may follow, we should never forget the right of every human being in front of the law.

One way or another, they will be free. It is practically impossible to keep spiritually free people in a physical jail. Woyannes don’t have the political (ethnic politics) and psychological (Military might) clout they once had either to control Ethiopia or to keep any patriotic Ethiopian in a real or perceptual jail. The basic principle of the law which states “you are innocent until proven guilty” has no place in weyane’s kangaroo court. It is a disgrace to the law schools which graduated these unprofessional cadre judges. I am suggesting to the law schools that these judges had attended to revoke their law diplomas and send a strong message to other would be kangaroo judges. Let’s find out which law schools they attended and inform their respective law schools about their unethical judicial conduct. Hammurabi the great of Persia is credited for the first crude legal code of a civilized society. The establishment of a government is the choice of the people to give a portion of their freedom and rights, for law and order protection of life and property. This is a major difference between the law of man and the law of the jungle. The later is survival of the fittest and it is not without its own merritts than mans, in a way the animals kill only when hungry. Man on the other hand if unchecked could kill, for many rational or irrational reasons. He can kill for a Nike shoe or for wearing the wrong color of a gang or a symbol of a religion, He kills for the lust of power and greed. Or, for pride in a duel, hatred, racism, regionalism, ethnicity, tribalism, clanism, insanity and war, even is capable of torture and genocide. Animals when their is a power shift of generations, the new boss tries to exterminate the infants of the former so that the mothers stop caring for the old ones cubs and start the business of procuring the fittest of the species and needs to pass his genes. They fight on food and to settle leadership, but accept submission conditional of not lusting the females. A small fish is a prey of one that is larger than itself and it in turn is swallowed by a bigger mouth, one is numerous enough to be preyed up on a hierarchically ladder.
I don't know, if these two young men are guilty or innocent, but I prefer to ere in favor of the justice system that has taken its time to find out the truth. They are found guilty but are not yet sentenced and they have the right to appeal to a higher court or accept their guilt and ask for a pardon if it is not to late. It is no logic that the big fish is let go because he asked for a pardon and it is granted. These two men stood for what they think is their right and it is up to the judge to see the facts and give his judgement and no body else's.
I feel at ease that the judge is a Muslim who have experienced injustice. He knows when he used to miss class unlike his Christian class mates, because a holiday is not a holiday for both. Thus to be or not to be in class is never a choice for one. They have not depended on government jobs to measure their value or worth and are not known to be impoverished on the contrary self employment had been a blessing in disguise and there is no business like business and are good at it. A Muslim judge I assume is from a wealthy family where he is not needed to make ends meet, in the absence of a raw model of success in the public sector. They were not called to render justice as we see it now, is not for lack of knowledge. One can also further infer that he want need no body's job to go against his conscious and become unjust to the orphan and the widower. I tend to believe it is the need of the state to provide justice to the people that more Muslims are on the job today more than ever before, because they are not adulterated by government power and craved for the taste they never tasted before. I bet my life it is better to get justice here than from a drunkard, illegitimate son of a single mother without culture of good character, norm and faith in a higher power.

Under what article of the criminal justice of Ethiopia such LAW exist?
This is to say you the accused have the burden of proving yourself innocent, otherwise we will convict you as guilty.

It is really funny and the judge must have been under graet deal of political pressure to come up with such illogical and unjust verdict.
One can imagine why this is so and I think , if the gov. loses here that the original accusation of CUD would be also for naught, as it is the CUD admitted of limited guilt and freed on pardon.

Please release these poor souls...they have already endured enough...there is no need to prove that you, the Governing party, are right.

This is again the justice system at work in Africa. When the gov’t don't like some people, they find excuses to put them away. This is typical…. I was hoping that they go free before the end of the year. I went to AAU with Daniel and I know him well. Netsanet is also a very close friend of Danny. Daniel is a decent and genius young man. However, he should have been careful when he was defying the government. They were setting him up into their trap. People who were also behind him are free and they were never jailed. But he was caught in the heat of the moment. They should have been mindful of the risk when they were jumping into fire.
I hope that they will let them free - The guilty verdict is a public relation gimmick on the government side. The point is that they were not just only poverty activists - they were involved directly in the election politics. Unfortunately, the politics in the third world is a game played with knives. The right thing to do for the government is to free them immediately. The pressure on Meles was building from EU, US & Human Right Orgs. He had no choice but to release the 38 opposition leaders and members before the Millennium. However, these leaders should have refused to walk free and negotiate conditions for their freedom to include freedom to each and every political prisoner in the country. Instead, they run fast at the first opportunity. That way the gov’t would have been cornered and forced to free all of them. Let’s hope that the gov’t will free them with a fake pardon or whatever means….who cares, how you got your freedom from a 3rd world jail. No one will recognize your sacrifice – people have short memories because they have so many other problems to deal with in their lives. Get real.. no one is remembering the hundreds of people massacred on the street of Addis. They are forgotten – so Daniel and Nesanet should just get out by any means. I don’t think that they should languish in jail another night in Kaliti to get the kind of justice they are looking for…

Eritrea today is building its military at an alarming rate while the rest of its citizens are starving to death. They did not learn their listens from 2000 and the most recent in Mogadishu when it’s 5,000 elite perished in less than a week. Today nearly 300 Eritrean military are crossing into Ethiopia and countless of them into Sudan. Very soon Eritrea will start calling its Diasporas to come and fight because its citizens at home are abandoning it to save their lives.

The only way we {Ethiopians} can build our nation and united our people without interference is that 1st we MOST destroy the state of ERITEA. 2nd kill all SHAEBIAN elements in ASMARA and MASSAWA. 3rd to do so we should acquired some dirty bombs from the U.S and use one of the U.S’s B-2 bomber plane to wipe Eritrean military from the face of the earth. The B-2 bomber is the easiest solution to kill and burry them at once. Upon the success of the bombing we should send our special forces and assist the good Eritreans to build a democratic gov’t and the HORN will be in peace. Otherwise, the longer we talk about it the longer Eritrean leaders will spread there hatred and interferences among our population. Once we accomplish the full return of our port and our territories, our economy will double and no short time our nation will be stronger. We have the manpower to build or nation quicker and at the same time we can have enough reserves in our military just in case there is military crisis in or outside our nation. we need strong economy and military to keep our nation in good shape!

When CUD leaders granted pardon, it was a win win situation for them and the woyane government, even though the were not supposed to be in prison at the first place. I am a proud son of ETHIOPIA and have no party affiliations. Another words, I don’t hold any memberships for any ET party. So, here is my ordeal about your people {ERITREANS}…1st of all I don’t believe in genocide or killing all ERITREANS but I do believe that to have peace in E. Africa: certain thinks need to change for the better of the people: of course this is solo my opinion, 1st, Eritrea has to stop supporting ONLF and UIC. 2nd, ERI leader should stop building hatred against ET and division among ET. 3rd, in order for both nations ERI&ET to live in peace both sides {leaders} most lower their egos and let the people live in peace like they did before the war started in 1998. Both sides lived as one for many decades and border was not an issue even in 1991 when MENGISTU was overthrown. ASSEB was used by ET until 1198 without any issues. Today, the port is becoming useless and both sides are hurting economically and neither side is willing to give in…

Prior to 1991, EPLF & TPLF ate slept together, shared everything together and stood together {all thus there was series problems created by EPLF in 1984 when they blocked ET people from entering to Sudan and watched them to die during the famine}. Of course, those are the few regrettable moments I clearly know that EPLF had mistreated ET people and again in 1998 when the war stared. The few examples that I choose to list above are not an attempt to blame ERI people but to give you an idea about me on how my feelings started to change towards to the ERI gov’t/ppl… I personally had close relationship {friendships} with many ERI/PPL until 1998 however since 1998 things went soured and I disliked ERI people very much. Perhaps, you might take it persona and get upset with me but in order clear communicate I need to be honest with you.

Now, the questions are endless, however we most start somewhere and start to ask each other and ourselves… how do we help our people to united? How can we respect all ERI/ET/Somalia {the HORN} etc and build better economy? How can we make a difference to the poor? We live in the west and we’re financially better off than most of our families in Africa… as an Orthodox Christian, I certainly DONOT believe in any kills however I have to admit that I have said kill ERI people to get some people in this form angry and perhaps, that is my weakness or naive-ness. Therefore, I shall stop here and allow you to share your views including your peaceful critics about my openness and honesties.

As fore me, the saddest, and the daunting agony is that, the so called, the none governmental agencies (NGOS) who are supposedly there to help organize, for the betterment of our people and country, gets dip in to our internal political and social affairs, will turn out to be the instigators of various social and political problems, and yet our government and many other African governments seems to be not taking an effective major to curtail the very social disobedience created by this NGOs.

This is the worst statment I have ever read delivered from a court. Judge Mohammed asserts in validating his decision "despite the lack of evidence proving their involvement in leadership and participating during the unrest, no evidence could be found to refute accusations of incitement." Such a statment full of contradiction might be expected of politicians who quite often talk both ways. But it is really sad a judge would deliver from his bench such a remark. If they had found to have no involvement in the unrest, how comes they become responsibile for the incitement? Moreover, the judge seems to say the government is accusing you two of incitements, it is your obligation to prove that the government is wrong. What the judge really saying is these two had no leadership positions in the opposition parties, nor participated in the demonstrations that followed the 2005 election; however,the judge seems to be not convinced that they might not have as well collaboration with the instigators of the unrest. If the government proves that to be the case, the government might have, although questionable, a reason to find them guilty as accused. That is not what the judge is saying. The judge states the government accused of you two with involvement in leadership, participating during unrest, and incitement. While the government has no evidence to lock you up for not having evidence for the former two, the third one which requires the government only to believe that you participated in the incitement, you failed to prove that you did not.
