Convicted killer fights to clear his name
A MIDDLESBROUGH man serving a life sentence after he was convicted of the murder of his housemate has launched an appeal to clear his name.
Dawit Asmelash, 32, brutally stabbed 25-year-old Haileab Tadesse to death at the home they shared in Palm Street, in
Middlesbrough town centre, in April 2011.
The east African was convicted last March of murder at Teesside Crown Court and jailed for life by Judge Peter Fox QC, the Recorder of Middlesbrough.
But he was back in court in front of the country’s senior judge at the Court of Appeal this week as his lawyers began a test case bid to overturn the jury’s guilty verdict.
Asmelash’s appeal is being heard alongside four other men who were jailed for murder and are now challenging their convictions on similar grounds.
The five appeals, before the Lord Chief Justice, Lord Judge, revolve around the new murder defence of “loss of control”, which replaced the old provocation defence.

It doesn't sound a good defense or an excuse. People are prosecuted and found guilty if they kill while driving drunk. That is even unintentional. In this case, the accused stabed his roommate to death. He even didn't try to justify it as a self defense, but claimed he was out of control because he was drunk. Doesn't make sense to me at all!!
BTW, East African? Is it the new name for the failled state of Sing-A-Poor?

Loss of Control I guess is like temporary insanity. Otherwise you can even argue a premeditated murder could be argued as loss of control because he lost control for weeks or months because he was just obsessed about the matter. So, loss of control defense they well be arguing with most likely is similar to temporary insanity.
