Attempt to deport Ethiopian terror link man fails

Home Secretary Theresa May has failed in a bid to deport a 33-year-old Ethiopian who had "thrown in his lot" with Islamist extremists "committed to terrorism".

The Court of Appeal said there was a risk that the man - who was not named in a ruling - might be subjected to "ill treatment" if returned to Ethiopia.

Three appeal judges overturned a ruling by the Special Immigration Appeals Commission (Siac) - which had upheld Mrs May's decision to deport the man, who has a wife and children in the UK.

They said Siac had "erred" in ruling that assurances given by the Ethiopian government were "sufficient" to prevent the man being "subjected to ill treatment" contrary to human rights legislation.

Lord Justice Jackson - the most senior of the three appeal judges - said he had reached his decision with "little enthusiasm".

Two important questions, first the weight between protecting the individual rights against torture and ill treatment vs national security and second issue is the trustworthiness of Ethiopia’s assurance of protecting the individuals right in the eyes of the court.

This kind of case would have been very easy to deport if it was the US court than that of European courts who are scared of the ECHR.

None of the associates sounds to be Muslims, I as far as I am concerned he could be an X Woyane. Regardless, I applaud the UK government and its courts for not throwing the man to the wolves.

That shows UK or any civilized country don’t trust Woyane’s kangaroo courts. If he did the crime and there is enough proof the individual can be tried in London. But as always the case, there is no proof just a smoke screen by gangs at Arat Kilo to get a hold of someone they don’t like

It is not the first time that the Home Secretary Theresa May has lost her attempt to deport the terrorists to their countries.The followings are few of them:
1) She has lost her attempt to deport the radical cleric Abu Qatada to Jordan,where he faces trial on terror charges the reason of not his deportation was torture could be used against him by the Jordanian authorities.

2) Abid Naser and Ahmed Faraz Khan,two known members of Al-Qaeda, were found to pose a serious threat to the National Security of the UK following their involvement of proposes bombings in Manchester. The two individuals were among suspects which were arrested in Manchester, Liverpool and Lancashire in 2009 following an extensive operation led by MI5.

They were to be deported from the UK back to Pakistan but were able to successfully argue their rights under the Human Rights Act as there was the potential that they could be tortured on their return.

3)At least eleven foreign-born terrorists who should have been deported from Britain after finishing prison terms are still walking the streets.The list is known to include Siraj Ali, who aided the failed July 21 suicide bomb plotters and was jailed for nine years.Ali is the foster brother of Yassin Omar, the failed Warren Street bomber, and housed Muktar Ibrahim, another of the would-be bombers, while the devices were being made in a council flat a floor below.
He is using taxpayer-funded legal advice to fight deportation to Eritrea.
