Ethiopia - High Court Denies Bail for Teddy Afro

The Federal High Court of Ethiopia has this morning denied bail for the release of Tewodros Kassahun (Teddy Afro). The 30-year-old sensational singer, who is accused of a hit and run homicide, will spend the duration of his trial in prison.

The court has ruled to hear four witnesses- all police constables- referred by the prosecutor against the singer on May 21, 2008. This was despite his defense lawyer Million Assefa’s request that the witnesses should testify within a maximum of one week, if not today.

We all love him for his talent and creativity how ever he should not be immune from the court of law if he actually had committed the crime. Our experience, however, has told us that any one with out any crime could end up in Ethiopian prison for simply a political view. But one has to ask, what if he commited the crime. If he does he should be punished like everyone else. By the time he was freed he has already served his sentence. By then the election issue has subsided.

Amare: it is a genuine question that you are asking and I had exactly the same question you had, when I heard the news that Teddy was being denied a bale. However, it is my understanding that, the higher court denied Teddy's lawyer request for bale out due to fears and suspicions by the higher court that, Teddy might rush (skip) out of the country to avoid serious charges. Since the prosecutors are believed to have a hard evidence that Teddy fled the seen of the accident with out seeking help or reporting the accident to the proper authorities, which would make it a crime punishable by law, if in fact he had caused the death and destruction of a human life.

But any how it is a premature case and we all are jumping the gun, we will see what happens.

ghion you are not making sense. if the court thinks teddy will break the bail and flee all they have to do is raise the amount of the bail. that is the common practice. besides if he didnt flee for the past 2 years what is the rationale for using that as excuse to throw him in jail. and according to the court the reason he is denied bail is because of the charges, which are the same charges 2 years ago when he was granted bail for over 2 years, so obviously the court can not be right both times.

A lots of things in a practice of law and court system is complicated, sometimes does not make sense and that is why lawyers from both sides of the isle argue relentlessly just to make some sense and convince the presiding judges and jurors.
Even though Teddy was allowed by the lower court to post a bail out and allowed to be free until the incident is investigated and clarified for the case to proceed forward in the court of law. The higher court can over rule the lower court's decision, if and when the higher court perceives that the defendant is potentially or likely can flee the country in order to avoid a possible criminal charge.
I will give you an example for what happen to Wesley Snips.
As you probably know, Wesley Snips was in contempt of law for a tax evasion and his lawyer requested for his client to be allowed to fly overseas for his acting job, the lower court granted him to go about his business for as long as he posted the required bail that was asked by the court, however in a latter date, the higher court denied Wesley Snips from flying overseas and had him surrender his passport, effectively preventing him from travelling, his lawyer appealed the higher court's decision, in which his lawyer was able to successfully reverse the decision by compromising with higher court and allow Wesley to travel by excessively hiking the dollar amount of the bail that was required for Wesley Snips to fly overseas.
Amare, most laws in any country you look at are resented by the overwhelming majority of the populous, but yet the public have no choice but to obey them and if we happen to be braking them, we have no choice but face the consequences.

I look at this matter as a matter of personal opinion, and based up on personal feeling as well as political affiliation, a resentment to a governing body of a government to show once disparity to wards an individual and or a governmental entity.

You and I can go on, no matter how long and with out a foreseeable conclusion and there no point of preceding with this discussion except to say, may GOD bless the soul of the diseased and may GOD with teddy for his redemption.

The man is charged with serious crime and some people want him out of jail because, according to some self- proclaimed legal analysts, he is an “Ethiopian hero”. It is an outrageous lie. Some of us like to believe that every one is equal under the law. There is no preferential treatment for any one who struck another human being and left him there to die. He has to serve time if convicted and could entertain inmates at the same time. Quite frankly, the man can not sing and when he does he is always off key. The due process is one is innocent until proven guilty.

Not imprisoning one first and then going to look for the evidence to link him/her with the alleged crime. The evidence has to come first before the imprisoning. Then if found guilty the imprisoning follows.
